Elvis files suit against Daimler

Europäische Ladungs-Verbund Internationaler Spediteure AG (Elvis) is planning a further lawsuit against Daimler AG and thus against the truck cartel via its subsidiary Themis Schaden GmbH. The claims resulting from the purchase of 10,000 vehicles are to be bundled in this action.

Elvis puts the average loss per truck at around 7,000 euros. This lawsuit will relate to the post-cartel period. The reason for the lawsuit: an economic expert opinion that comes to the conclusion that the cartel also had an impact on the period after January 2011. "The freight forwarders and transport companies also paid more for the trucks they purchased in the post-cartel period than they would have had to pay without the cartel," explains lawyer Dr. Moritz Lorenz from the Berlin law firm Arnecke Sibeth Dabelstein, who is also representing Elvis in court in these proceedings. The cartelists are also obliged to compensate for this damage. The lawsuit is to be filed next year, probably also at Stuttgart Regional Court.
